How Statutory Maternity Pay Works

Statutory Maternity Pay (SMP) is the minimum amount your employer must pay you when you take maternity leave. It is paid for up to 39 weeks — you can take up to 52 weeks of maternity leave in total, but the final 13 weeks are unpaid.

The first 6 weeks are paid at 90% of your average weekly earnings (AWE), with no cap. This is the "enhanced" period. The remaining 33 weeks are paid at the lower of 90% of AWE or the statutory flat rate (£187.18/week for 2026/27).

Your AWE is calculated from your earnings in the 8 weeks (or 2 months if paid monthly) immediately before the 15th week before your due date — known as the "relevant period". Bonuses and overtime paid in this period count towards your AWE.
